FSpaces — Terms of Service

Version 2026-09-09 · Effective 9 September 2026

These terms are the agreement between you and the person who publishes FSpaces. Please read them — by creating an account you agree to be bound by them.

1. Who we are

FSpaces is published by Jean-François Duval, an individual sole proprietor at 1948 Rue du Centre, Montréal, Quebec H3K 1J2, Canada ("we", "us"). You can reach us at contact@divindudu.dev.

2. Who may use FSpaces

You must be at least 16 years old. By creating an account you confirm that you are.

You must not use FSpaces if you have previously been removed from it, or if the law where you live prohibits you from doing so.

3. Your account

You sign in with your phone number and a one-time code we send you by SMS. You are responsible for keeping access to that phone number secure. If you lose control of it, tell us straight away — anyone who can receive your codes can sign in as you.

One person, one account. Do not create an account for someone else or impersonate anyone.

You can delete your account at any time from Profile → Delete account. What that removes is set out in our Privacy Policy.

4. Spaces and invite codes

A space is a private area for an event. Whoever creates it is its host. People join using the space's invite code.

Anyone holding the code can join. The code is the access control — there is no separate approval step. Share it only with people you want in the space, and understand that anyone you share it with can pass it on. Hosts can remove content and members from spaces they host.

5. Your content

Everything you put into a space — photos, videos, links, songs, messages, comments, checklist entries — remains yours. We claim no ownership of it.

To run the service we need your permission to handle it. You grant us a worldwide, non-exclusive, royalty-free licence to store, reproduce, adapt (for example, to generate thumbnails) and display your content, solely for the purpose of operating FSpaces and only to members of the spaces you put it in. This licence ends when you delete the content or your account, save for copies retained briefly in backups or where we must keep something to comply with the law or handle a report.

You confirm that you have the right to share what you upload, and that doing so does not infringe anyone else's rights.

6. Acceptable use

We have no tolerance for objectionable content or for abusive behaviour. Content that breaches this section is removed, and the account responsible may be warned, suspended or terminated.

You must not use FSpaces to post, share, or do any of the following:

You must also not scrape the service, reverse engineer it, circumvent rate limits or access controls, or use it to build a competing product.

7. Reporting content and blocking people

FSpaces includes a way to report any message, photo, link, song or checklist entry, and a way to block another member. Blocking hides that person's content from you and prevents them from interacting with you.

You can also report content to us directly at contact@divindudu.dev.

We review reports and aim to act within 24 hours. Depending on what we find we may remove the content, warn the person responsible, suspend them, or terminate their account. We may act without prior notice where the content is seriously harmful or unlawful. We will tell you the outcome of a report you made where it is appropriate to do so.

We do not pre-screen content. Spaces are private to their members, and we do not read them unless a report brings something to our attention or the law requires it.

8. Suspension and termination

We may suspend or terminate your access if you breach these terms, if your use puts other people or the service at risk, or if we are required to by law. Where it is reasonable to do so we will tell you why and give you a chance to respond.

You may stop using FSpaces at any time by deleting your account. Sections 5 (as to licences already granted for content you have not deleted), 9, 10, 11 and 12 survive termination.

9. Third-party services

FSpaces uses Apple Music to search for songs, Apple Maps to look up venues, Apple's push notification service for alerts, Apple Intelligence to write the note above a space's playlist and to draft a space from a sentence you write, and your device's calendar if you allow it. Your use of those features is also governed by Apple's own terms. Links shared in a space lead to sites we do not control and are not responsible for.

10. Availability and disclaimers

FSpaces is provided "as is". We do not promise it will be uninterrupted, error-free, or that content will never be lost. It is not a backup service — keep your own copies of photos and videos that matter to you.

We may change, suspend or discontinue features. If we discontinue the service altogether we will give you reasonable notice and a means to retrieve your content.

To the fullest extent permitted by law, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

11. Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profits, or loss of data. Our total liability arising out of or relating to these terms is limited to the greater of the amount you paid us in the twelve months before the claim, or CAD $100.

If you are a consumer, nothing in these terms limits rights you have under the mandatory consumer protection law of your country of residence, and nothing excludes our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. Where such law conflicts with this section, that law prevails.

12. Governing law and disputes

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable there, and the courts of Quebec have jurisdiction.

If you are a consumer resident in the European Union or the United Kingdom, this does not deprive you of the protection of the mandatory law of your country of residence, and you may bring proceedings in your local courts. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.

13. Changes to these terms

We may update these terms. If a change is material we will notify you in the app or by notification at least 14 days before it takes effect. Continuing to use FSpaces after that means you accept the new terms; if you do not, delete your account.
